DSHEA becomes law
In 1994, the Dietary Supplement Health and Education Act (DSHEA) changed how the FDA views weight loss products. The new law shifted the FDA’s role from pre-market clearance to post-market enforcement. It also passed the responsibility of making sure products are safe from the government to the weight loss industry.
What that means is, the law created a definition for a class of products called “dietary supplements” and said that these products are “foods.” The effect? Two classes of weight loss products were created.
The first class includes products that treat obesity and non-dietary supplements meant for weight control. These products still have to get pre-market approval. The second class includes dietary supplements for weight control. For these products, statements on the label have to be truthful and not misleading.
But in the case of the second group, these products don’t have to have pre-market approval. The FDA is not required to make sure the manufacturers have evidence of efficacy or safety. So the weight loss dietary supplements you see and hear about are not required to prove that they work — unlike prescription or FDA approved non-prescription drugs, which must have evidence from clinical trials.
